The Abuja Division of the Court of Appeal has dismissed two motions brought by Senate President Godswill Akpabio and imposed a ₦100,000 cost against him.
The ruling was delivered by a three-judge panel led by Justice Hamman Barka on May 21, 2025, following Akpabio’s request to withdraw the motions.
A certified copy of the court’s decision was obtained by PUNCH Online on Tuesday night.
The motions, filed on March 3 and March 25, 2025, and marked as CV/395/M1/2025 and CV/395/M2/2025, had Akpabio listed as the appellant.
The respondents included Senator Natasha Akpoti-Uduaghan, the Clerk of the National Assembly, the Senate, and Senator Neda Imasuen, who chairs the Senate Committee on Ethics, Privileges, and Public Petitions.
In his filings, Akpabio sought the court’s permission to appeal a Federal High Court judgment delivered on March 10, 2025, by Justice Obiora Egwuatu in suit number FHC/ABJ/CS/384/2025, where Akpoti-Uduaghan had challenged the Clerk of the National Assembly and three others.
He asked the appellate court to extend the deadline to file a notice of appeal, grant leave to appeal the ruling on grounds involving mixed issues of law and fact, and pause any further proceedings in the Federal High Court case until the appeal was heard.
However, upon his request to withdraw the motions, the Court of Appeal struck them out and ordered Akpabio to pay ₦100,000 in costs to the first respondent, Senator Akpoti-Uduaghan.
The panel also directed that Appeal No. CA/ABJ/PRE/ROA/CV/395M/2025 be removed from the court’s list.
